Company domiciliation approval at the prefecture (Saint-Martin)

Who must apply, and how long it takes

Any application for approval by a business providing legal domiciliation must be addressed to the prefecture.

The prefect has two months from receipt of the approval application to consider the file.

No reply within that period counts as refusal of the application.

Approval is granted for a period of 6 ans (years).

The completed declaration form: sole-trader declaration for a sole trader, or company declaration for a legal entity.

A sworn statement, completed and signed by the sole trader or by all directors and partners of the business holding more than 25% of the shares.

A double-sided copy of valid photo identification.

Title deed or valid commercial lease for the premises.

A K-bis extract less than 3 months old.

Cadastral records, or a site plan, or a description accompanied by photographs of the premises.

A stamped envelope.

Any substantial change calling into question the conditions of the initial approval must be declared to the sub-prefecture.

Approval may be suspended for 6 mois (months) or withdrawn by the prefect when the domiciliation business no longer meets the conditions.
